Terms of Service

The rules governing the use of the LogFit® platform

Purpose and scope

These Terms of Service (ToS) govern access to and use of the LogFit® platform, operated by Pax Technologies (BCE/VAT BE 0771.359.440), available at logfit.eu and its subdomains.

Any use of the service implies full acceptance of these Terms. If you do not accept them, you must not use the platform.

Definitions

"Platform" means the LogFit® service; "Organizer" means any user creating and managing events; "Athlete" means any user registering for an event; "Event" means a competition or sporting event published on the platform.

Access to the service

LogFit® strives to keep the platform available 24/7, without guaranteeing the complete absence of interruptions (maintenance, technical incidents, force majeure).

Access to certain features requires creating an account. The user is responsible for keeping their credentials confidential.

Registrations and payments

Event registrations are handled through the platform. Payments are processed securely by our provider Stripe:

  • Prices are shown in euros, all taxes included, before payment is confirmed.
  • LogFit® applies a service fee on the base registration amount; Stripe transaction fees are separate.
  • No payment card data is stored by LogFit®; it is processed exclusively by Stripe.
  • Cancellation and refund conditions are set by each Organizer for their event.
  • LogFit®'s service fee is non-refundable, whatever the Organiser's cancellation policy: if a registration is cancelled, the Athlete is refunded the Organiser's share. The Organiser may choose, at their own expense, to refund that fee as well.

Registration is only final once payment is confirmed.

Organizer obligations

The Organizer undertakes to:

  • provide accurate and up-to-date information about their events;
  • comply with regulations applicable to organizing sporting events;
  • process participant data in accordance with the GDPR;
  • ensure the smooth running and safety of their events.

Collection and invoicing mandate

By creating an organization on the platform, the Organizer mandates Pax Technologies SRL (company/VAT number BE 0771.359.440), publisher of LogFit®, hereinafter "the Agent":

  1. to collect, in its name and on its behalf, through the payment provider Stripe (Stripe Connect), the price of registrations for its events. The amounts collected belong to the Organizer; they are paid out to it, less the LogFit® service fee and Stripe transaction fees, according to Stripe's payout schedule;
  2. to draw up and deliver, in its name and on its behalf, the payment receipts addressed to Athletes and the sales statements summarizing the proceeds of its events, in accordance with Article 53, § 2, paragraph 2 of the Belgian VAT Code, which allows an invoice or an equivalent document to be issued in the name and on behalf of the taxable person by a third party.

These documents are drawn up on the basis of the information provided by the Organizer, in particular its VAT regime, which it declares under its sole responsibility and keeps up to date in its organizer area. The Organizer remains solely liable for its accounting and tax obligations (returns, VAT, record keeping); the Agent acts only as a technical, collection and invoicing intermediary and is neither the seller nor the organizer of the events.

Each document issued in its name is made available to the Organizer in its organizer area. The Organizer has thirty days from that date to dispute it in writing at contact@logfit.eu; failing which it is deemed accepted. Documents issued under this mandate bear the Agent's name and company number.

The LogFit® service fee is invoiced separately, by Pax Technologies SRL in its own name, to the Organizer. Its amount and calculation method are those displayed in the organizer area when the event is configured.

The mandate also covers registrations collected by the Agent on behalf of the Organiser before these Terms were accepted. By accepting them, the Organiser ratifies those collections and authorises the Agent to draw up, in its name and on its behalf, the corresponding sales statements, under the same conditions as for later registrations.

The mandate takes effect upon acceptance of these Terms and remains in force for as long as the organization exists on the platform. The Organizer may revoke it by e-mail to contact@logfit.eu; the revocation applies to registrations opened after its receipt and does not affect documents already issued.

Acceptance and traceability

The Organizer accepts these Terms, including the collection and invoicing mandate, by ticking the box provided for that purpose when creating its organization. LogFit® records the date and time of that acceptance, the user account that gave it and the version of the Terms accepted.

When the Terms are amended, the new version is presented to the Organizer on its next login to the organizer area; continued use of the service is subject to its acceptance, recorded in the same way. The Athlete accepts the Terms when registering for an event; that acceptance is recorded with the registration.

Athlete obligations

The Athlete undertakes to:

  • provide accurate information when registering;
  • comply with the rules of the event they take part in;
  • ensure they are physically fit for the sport concerned.

Intellectual property

The LogFit® trademark, logo, interface and all elements of the platform are protected. The LogFit® trademark is registered with the EUIPO under number 019292661 (classes 9, 35, 41 and 42). Any unauthorized reproduction is prohibited.

Image Rights

By registering for an event via LogFit®, you accept the following terms regarding the use of your image:

  • Photographs and videos may be taken during events organized via LogFit®.
  • This content may be used by LogFit® and/or the event organizer for promotional, editorial and communication purposes.
  • The media concerned include in particular: website, social media, newsletters, marketing materials, press and any other media.
  • This authorization is granted free of charge, with no limit of duration or territory.
  • You may request the removal of content featuring you at any time by writing to contact@logfit.eu.
  • This authorization concerns adult participants. The image of a minor participant will not be used for communication purposes without the prior consent of their parents or legal guardians.

By completing your registration, you confirm that you have read and accepted these image-rights terms. If you do not wish to appear in this content, please notify the organizer on the day of the event and contact@logfit.eu.

Limitation of liability

LogFit® acts as a technical service provider. As such:

  • LogFit® is not the organizer of the events published and is not a party to the contract between the Athlete and the Organizer;
  • LogFit® cannot be held liable for the content of events, their cancellation or their running;
  • LogFit®'s liability is limited to direct and foreseeable damages attributable to a proven failure of the platform.

Nothing in these Terms limits LogFit®'s liability in the event of gross negligence or within the mandatory limits of the law.

Personal data

The processing of personal data is described in our Privacy Policy, compliant with the GDPR. The use of cookies is detailed in our Cookie Policy.

Changes to the Terms

LogFit® reserves the right to amend these Terms. The applicable version is the one in force on the date the platform is used.

Governing law and jurisdiction

These Terms are governed by Belgian law. Any dispute falls under the exclusive jurisdiction of the Belgian courts, subject to mandatory consumer protection provisions.
